Terms of Use
1. Acceptance of these Terms
Welcome to the Nourish Canada website. These Terms of Use govern your access to and use of nourishcanada.ca, including its pages, forms, donation features, articles, images and other content.
By accessing or using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree with these terms, please discontinue use of the website.
Nourish Canada may update these Terms of Use periodically. Any changes will be posted on this page with a revised “Last updated” date. Your continued use of the website following an update constitutes acceptance of the revised terms.
2. About Nourish Canada
Nourish Canada is a federally incorporated Canadian not-for-profit organization working to reduce hunger, improve access to nutritious food and build partnerships that redirect quality surplus food to communities where it is needed.
The information and services described on this website may change as our organization, programs, partnerships and geographic reach develop. Nothing on the website guarantees that a particular program, volunteer opportunity, partnership, food collection service or other resource will be available in every community.
3. Permitted use of the website
You may use this website for lawful, personal and informational purposes, including learning about Nourish Canada, contacting us, submitting an inquiry, applying to volunteer, subscribing to updates or making a financial contribution.
You must not:
-
Use the website for fraudulent, unlawful, abusive or misleading purposes.
-
Submit false, inaccurate or impersonated information.
-
Attempt to gain unauthorized access to the website, accounts, databases or connected systems.
-
Introduce viruses, malware or other harmful technology.
-
Interfere with the website’s operation, security or availability.
-
Copy, scrape, republish or commercially exploit website content without authorization.
-
Use Nourish Canada’s name, logo or materials in a way that suggests an unauthorized partnership, endorsement or affiliation.
-
Infringe the rights, privacy, dignity or safety of another person.
We may restrict or block access to the website where we reasonably believe these terms have been violated or the website’s security or integrity is at risk.
4. Website content and intellectual property
Unless otherwise stated, the website and its content—including the Nourish Canada name, logo, visual identity, photographs, graphics, text, videos, documents and page design—are owned by or licensed to Nourish Canada and are protected by applicable intellectual-property laws.
You may view and share links to publicly available pages for personal, educational and non-commercial purposes. You may not reproduce, modify, distribute, sell, license, publish or use our content for commercial, fundraising or promotional purposes without prior written permission.
Third-party names, logos, images and trademarks remain the property of their respective owners. Their appearance on the website does not necessarily imply sponsorship or endorsement.
5. Accuracy and illustrative content
Nourish Canada aims to keep website information accurate and current. However, content may occasionally contain errors, omissions or outdated information. We do not guarantee that every page will always be complete, accurate or available.
Program descriptions, anticipated activities and statements about future goals may describe Nourish Canada’s plans or vision rather than services currently operating in every location.
Some website photographs or videos may be stock, staged, illustrative or generated with artificial-intelligence tools. Such visuals are intended to communicate our mission and values and should not be interpreted as documentation of a specific Nourish Canada program, volunteer, partner, food recipient or beneficiary unless clearly identified as authentic program material.
Statistics and information obtained from outside sources remain subject to the methodology, publication dates and limitations of those sources.
6. Forms, applications and user submissions
When submitting information through a contact, volunteer, partnership, sponsorship, food-donation or other website form, you agree to provide information that is accurate and that you are authorized to provide.
Submitting a form does not create an employment, volunteer, partnership, agency, donor or contractual relationship with Nourish Canada. It does not guarantee that an application, food offer, partnership proposal or request will be accepted.
Volunteer opportunities may be subject to availability, eligibility requirements, interviews, references, orientation, training, parental or guardian consent, background screening or other safety measures appropriate to the role.
Food-donation and partnership offers remain subject to operational capacity, food-safety considerations, transportation requirements and approval by Nourish Canada. Do not leave or deliver food at a location unless arrangements have been confirmed.
You retain ownership of original material you submit. However, when you intentionally provide a testimonial, story, photograph or other material for publication—and grant the required permission—you authorize Nourish Canada to use it for the agreed purpose. We will seek additional consent where appropriate, particularly for identifiable children.
7. Donations and recurring contributions
Financial contributions made through the website are processed using Wix and its connected payment providers. Those providers may apply their own terms, conditions and privacy practices.
By making a contribution, you confirm that:
-
You are authorized to use the selected payment method.
-
The information you provide is accurate.
-
The contribution is voluntary.
-
You understand the purpose or campaign identified on the donation page.
Unless specifically stated otherwise, contributions support Nourish Canada’s overall mission and may be directed to the area of greatest need. Campaign descriptions and funding goals do not guarantee that a specific project will proceed exactly as described if circumstances, community needs or available resources change.
Nourish Canada is a not-for-profit organization and is not currently representing itself as a registered charity. Unless and until Nourish Canada becomes legally authorized to do so, payments will not receive an official charitable donation receipt for Canadian income-tax purposes. A payment confirmation or ordinary receipt is not an official charitable tax receipt.
Contributions are generally non-refundable. If you believe a payment was made in error or without authorization, contact us promptly at info@nourishcanada.ca. Refund requests will be reviewed individually and remain subject to applicable law, organizational policies and payment-provider requirements.
Recurring contributors may cancel future payments using any cancellation tools provided by the payment platform or by contacting Nourish Canada. Cancellation will apply to future scheduled payments and does not automatically refund contributions already processed.
8. Email communications
You may voluntarily subscribe to newsletters, fundraising messages, event notices and organizational updates.
You may unsubscribe from promotional communications at any time by using the unsubscribe link in an email or contacting info@nourishcanada.ca. We may still send necessary administrative messages concerning a donation, form submission, volunteer application, event registration or existing relationship.
9. Privacy
Our collection, use, protection and disclosure of personal information are governed by our Privacy Policy, which forms part of these Terms of Use.
Please do not submit unnecessary financial, medical, identification or other highly sensitive information through a general website form.
10. Third-party websites and services
The website may contain links to social-media platforms, payment processors, embedded videos, mapping tools or other third-party websites and services.
These third parties are independent from Nourish Canada. We do not control their content, availability, security or privacy practices, and inclusion of a link does not necessarily mean that we endorse every statement, product or service available through it.
You access third-party services at your own discretion and should review their applicable terms and privacy policies.
11. No professional advice
Website content is provided for general informational and educational purposes. It is not legal, medical, nutritional, financial, tax or other professional advice.
You should obtain advice from an appropriately qualified professional before making decisions based on information found on this website.
12. Disclaimer and limitation of liability
The website and its content are provided on an “as available” basis. To the extent permitted by applicable law, Nourish Canada does not guarantee uninterrupted access, error-free operation or that the website will be free from harmful components.
To the extent permitted by law, Nourish Canada and its directors, officers, employees, volunteers and representatives will not be responsible for indirect, incidental, special or consequential loss resulting from your access to, reliance on or inability to use the website or a linked third-party service.
Nothing in these Terms of Use excludes responsibility that cannot legally be excluded or limited.
13. Governing law and general provisions
These Terms of Use are governed by the applicable federal laws of Canada and the laws of the province or territory in which Nourish Canada maintains its principal registered office.
If any portion of these terms is found to be invalid or unenforceable, the remaining portions will continue in effect.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
